We hope that you, your family, and close friends, are doing well in the midst of the COVID-19 emergency. We want you to know that the Fulcro Insurance team will continue to monitor the development of this new reality closely in order to identify all the ways in which we can put the balance in favor of our clients.
Rest assured that our team is here to answer your calls and communications to clarify the most important questions that may arise during this situation. As is the general opinion presented by the Insurance Commissioners of various states, and the commissioner of the state of Georgia: “Viruses and disease are typically not an insured peril unless added by endorsement. Most policies generally exclude loss caused by or resulting from any virus, bacterium, or other microorganism that induces or is capable of inducing physical distress, illness, or disease.”
Typically, commercial policies do not cover this type of exposure. Most insurers have explicit exclusions for communicable or infectious diseases caused by bacteria, viruses, or the like. It could be argued that the pandemic has had a direct impact on operations, but this will largely depend on the type of insurance contract and for the most part, these are allegations that would end in judicial forums. In these circumstances, our team will be working hand in hand to evaluate each case individually.
Another issue that we are looking very closely at is Workers’ Compensation. Workers’ Compensation only covers work-related injuries or illness, so the people who would be covered during the current special situation, are those whose jobs force them to expose themselves to the virus, such as doctors, nurses, and police, among others. We have been receiving many questions regarding these terms and will evaluate these inquiries on an individual basis.
